EB2 versus EB3 for Labor: Need Urgent Advise

Hi,

I need help.


I have a BE and an MBA from india. I have total of 76 months of work experience of which 30 month was after my BE and before I did my full time MBA.

Now I want to apply for labor for my GC. My lawyer is saying he can file me under EB3 as a software enginner. My question is :


I have a BE in electronics and communication and have total 76 months of experince in software .So why cant i be filed under EB2 ?

What is the criteria to decide whether u u qualify for EB2. i thought if i have BE+5 years of experience then I can qualify for EB2.

please advise.

The position must require a Master's Degree of a Bachelor's Degree AND five years PROGRESSIVE experience. Your qualifications are not the only considerations and it does not sound as if you have 5 years experience post Bachelors therefore you cannot possibly have 5 years PROGRESSIVE experience.

It sounds as if your attorney knows what s/he is talking about.
