EB2 'unavailable' and A# question.

:confused: Can someone please explain the impact of the EB2 category for India becoming 'U' (unavailable) in the most recent visa bulletin. I was current since the May bulletin issued in April 2005. Here are the details:

Labor sub., PD : Nov., 2002.
485 RD : Sept 2005
485 applied at Nebraska Service center and per the latest processing time report for Nebraska service center, it is processing employment-based adjustment applications received until Nov. 1, 2005. Therefore, I am assuming that my application should now be picked up given that both the priority date and the service center processing dates are current. But, what is the impact of the EB2 category becoming 'U' in the visa bulletin. I did receive an A# when the 485 application was filed in Sept. 2005.

Gurus?? anyone ?? please explain.

Will the application be processed only if the visa numbers are available (or does having an A# imply that the visa number is already assigned and therefore they should pick up the application (hopefully??) and process it).

A# does NOT mean that a visa number was alloted to you.
Its just a unique number assigned to your file and to track your case.

If you don't get approved by the end of this month (or maybe a few days into Aug depending on the timing), then you need to wait till the visa number becomes available again.

Since you only filed in Sep 2005, there is a very high chance that your namecheck has not been completed.

But EB2 should get numbers back in the Oct bulletin - so you should be good to go.

Consider yourself lucky to have a sub labor in 2002 and filing only in end of 2005 --that's a very short wait by normal standards here :D

About considering myself lucky .... well I would say so when it finally comes through (after who knows how long ... ). Otherwise, its been a fairly long journey. Applied for EB3 (RIR) in May 2001. Labor was rejected with the option of going into normal processing (non-RIR), which was pending/lost forever. Later, my company then finally agreed to re-file with EB2 (sub-labor) in mid-2005. Meanwhile, almost all of my friends/acquintances etc. got thru while I was among the first to start the process. Anyway ... just hoping (like so many others on this forum) to be done with the GC thing asap.
