EB2 qualification

Does a person with 3 years recognized foreign Bachelor of Computer Science degree with 1 additional year of incomplete Masters program from the same university (a total credit of 131) would qualify as having US equivalent degree? The incomplete Masters degree was also in computer science inaddition to about 10 years experience afterwards.

As you know, the EB-2 category is for professionals holding advanced degrees. In lieu of an advanced degree you can use the equivalent of a Bachelor's Degree (from US or equivalent from a foreign institution) plus 5 years of progressive experience post-obtaining such Bachelor's Degree in the specialty of the degree.

Also, the experience cannot be for the sponsoring employer and the experience must be a job requirement.

From what you describe, you cannot use your Masters' Degree as it was incomplete. But you may be able to use the experience following your Bachelor's Degree. This assumes that your employer requires such experience for the job and you did not obtain at least 5 years of that experience from your current employer.

Thanks for you response. Following is the information I got from a forum. Based on that, there is no seeming possibility of considering experience as the alternate of the lack of 4 years education.

USCIS does not accept a combination of education and experience to make up for a degree in trying to obtain EB-2 classification. In order to qualify for EB-2, the position of USCIS is that the position must require at least a MS degree or a BS +5 years post baccaluareate experience. In order to meet that requirement USCIS will currently accept the following:

1. U.S. Master's Degrree
2. 4 year BS + 2 year MS
3. 3 year BS + 3 year MS in related field
4. 3 year BS + 1 year Post-grad diploma + 2 year MS if all in related fields
5. 3 year BS + 2 year MS + 5 years post MS experience
6. 4 year BS + 5 year post BS experience.


If the position is for EB-3 classification and requires a Bachelor's degree, the USCIS will generally accept an equivalency that uses a combination of educational programs, if the Labor certification indicates that the Employer will accept a combination of education to qualify for the BS or equivalent.
