Eb2 or EB3

How can we tell whether a case is in EB2 or EB3? is it determined by the Labor approval or 140 approval, if they are different?

when my attorney filed the case she told that she is going to file in EB3. But when i recently checked the 140 approval notice it says Eb2 description(Mem of adv degree or exce ability). Is there any where in LC we mention that the case is EB3/EB2?

So, this is the first time in this forum. My information is mostly what I have known from friends. My signature shows my status. I am waiting on response. Anybody who is in the same timeframe and has received their GC do anything different? I have called CRIS, initiated a request from my Senator and am waiting on response. I have also heard that doing some community work to raise money for one of their omnibus funds helps, but havent seen anybody yet benefited from that. Can anybody please reply? Retrogression doesnt really help any of us and I know there is a petition to not have CRIS do retrogression anymore, but I dont know how much that will fly. Also, the Latest FEB08 bulletin says that EB2-India is "U", which means that dont really have any changes yet, I assume.

Can you please provide the details on how to initiate a request from our Senetor ? What did you have to do for this to happen.

Just log on to your state website and find the senators for your state. They will defer you to the congressman offices that represent the state in the congress. They have people dedicated to take in inquiries like these and have a form that you will need to fill out. Once you filled it out, they normally take about a week or two to get the response back from INS.
I am still waiting on the response. They sent the inquiry to INS Tuesday (last week). So its been almost 9 business days.
