I am in new york state and I just found that I finally got my LC approved (filed on 2/2003).
I was told that “When the LC application is filed with the New York State Department of Labor, they do not use a preference category such as EB-2 etc. After approval of the labor certification, then the EB-2 category could be used for advanced degree category”. Is that true?
I remember when my employer posted the advertisement for my position, it didn’t say it needs Master’s degree (even I have a Master’s degree) and it said that it needs bachelor degree and 2 years work experiences.
Would that be a problem for me to file my I-140 and I-485 under EB-2 category?
