I got my LC approved using EB2. Now my laywer suggests to file I-140 using EB3 (as he has some doubts about this).
Questions:
1. If I file I-140 as EB-3 my case is EB2(based on LC) or EB3(based on I140) as far as 485 is concerned?
2. If I file I-140 with EB2 (thinking premium processing), and if it get rejected, can I still use the LC and apply again EB3? Will I get back the orginal LC which will be filed with EB2?
3. I did 10+3(diploma in mech engg) + AMIE (mechanical). Later I did PGDCA and other courses. After degree experience is more than 14 years in IT. Anybody has similiar situation and got EB2?
