EB2 or EB3 ? Please advice

Hi,

Can anyone please let me know the exact requirements for PERM - EB2 filing ?

I have more than 5years experience in the field i am working in, prior to joining the current company and Bachelors in Engineering. Can i apply for EB2 ?

My company has started recruitment process and the only requirement which is been asked in the ads is - 5years of experience + bachelors in enigeering. Is this requirement sufficient for filing in EB2 category.

Lawyer says my case can be filed in EB2. But I want to be sure that this is possible.

Please advice..

Yes. You can file under EB2. Your lawyer is right. A minimum job requirement of BS+5 yrs on the PERM application will qualify you for EB2 category. Further, since the 5 yrs of experience you have gained is not from your current LC sponsoring employer, you should be fine.

Thanks for clarifying that. In my case, do i need to produce a business necessity document. How important would be the answer to H12 question.

Just make sure your 5 years of experience are following the bachelor degree. If any of these 5 years were gained before the BS or while you were studying , then those years do not count.
Please verify that with someone else. This is what I know about EB2.

Yes, you are right. Only post-Bachelor's experience counts. Experience gained before getting Bachelor's is not useful for EB2.

If you answer "No" for H-12 on ETA 9089, then you need to produce business necessity document.

Answering "Yes" or "No" for H-12 depends on SVP Level of your occupation and SVP Level of your minimum job requirements.
 
I inferred based on the wage suggested through a link provided in this forum

O*Net™ JobZone: 4 -- Education & Training Code: 5-Bachelor's degree

and SVP >7 and <8.

Hope i got this correct.
