EB2 or EB3? JobZone:4 & Bachelor's degree

PERM:EB2 or EB3? JobZone:4 & Bachelor's degree

My PERM application was filled at Chicago center on 8/11/05.
I was checking in DOL's site (OES Search) for my position for which PERM was applied for:
15-1032.00 Computer Software Engineers, Systems Software.
I have Masters + 10 years IT & Research Experience, I don't know any detail of advertisement what qualification they require in advt?

Search result comes up with following info:
This wage applies to the following O*Net occupations:
OES/SOC Code: 15-1032
OES/SOC Title: Computer software engineers, systems software
O*NetT JobZone: 4
Education & Training Code: 5-Bachelor's degree

What does it suggest? EB2 or EB3 category?

Unfortunately, it is EB-3 my freind. Also, if you have Masters from India with 3 yrs of Nachelors, it will be an issue.

Are you saying this EB-3 just looking at the TITLE? or do you have any other justification?

I talked to my Attorney and he said that mine is filled as EB-2 based on the requirement of (Masters + Experience), based on Job title I searched it as find those info posted above. I have M.Tech from Indian Institute of Technology WITH 2 YEARS of Post Graduate Diploma (Equivalent to M.Sc) in Engineering & Three Years Bachelors degree, + 10 Years of IT & RESEARCH experience.

My Education Evaluation Evaluates my 3 years Bachelors Degree + 2 years PG diploma as equivalent to 4 years US Bachelors Degree in Engineering, And my M.Tech degree is evaluated as equavalent to 2 years MS degree from US. So I don't see any issue because my Education Evaluation says 4 years EQUAVALENT Bachelors Degree + 2 years Equavalent Masters Degree.

In PERM system the normal requirements for the Software Engineering position is defined as having BS degree and less than or equal to 4 years of experience. If you go above the normal requirement then your company has to show business necessity. If asked by DOL (Audit) then your company has to provide documentation and expalain why they need a candiate with above the normal Education/Experience combination.
