EB2-NIW: Publication+Manuscript in preparation

I am wondering if it has positive / negative or no effect if I include the manuscripts in preparations in my publication records. I am expecting this to be published (99% work done) in next 3-6 months.
Any comments?

I really don't think you can submit them.

It's not possible that a work in prep can be considered evidence of a contribution to the field when it hasn't even gone through peer review.

Plus there is an explicit rule that evidence must be in place by the date of your submission-- for example, if you did get your manuscript published a few months after you submit your packet, you are not allowed to include it in the event you are issued an RFE.

Good luck!

It doesn't hurt to include it on your CV if you have lots of other publications there as well. As the above post said, NIW will only be considered based on your qualifications on the date of original I-140 submission, and any publications afterwards will not boost your case (although will still be useful if, after I-140 approval, the USCIS wants to see evidence that you are still publishing in your line of work before final approval of your I-485, especially if I-485 takes too long).

However, if your application is depending on this publication to boost your record, then as the above post said, it won't do you much good.

Hi Imli,
I had included papers in progress/review in my CV submitted with NIW package.

In my opinion it will have neutral or positive impact because it goes to show that you will continue to work in the same field and justifies projections of future benefit to the national interest. Also useful to address "need for exemption from labor certification" criteria.

Good luck.

Thanks a lot for your input. I have 12 publications, 8 as first authors. But still wanted to include few just to make the case stronger (but wanted to make sure that there is no negative effect or I am not violating the rule).

Hi all,
Can I send manuscprits of papers which has been accepted for publication as supporting documents...I have 2 of this type? It might take more than a month or two for them to be available online. Will they be counted towards my application?

Any inputs are welcome.
Thank you.

niwguru,

Accepted but unpublished papers went through a peer review process. They are definitely more important than manuscripts of papers not refereed yet.

You could use them in an RFE because they were already written and accepted when you filed: if they get cited quickly, it can definitely help proving your contribution in the field.

If I understood you correctly, you mean to say that I can include my unpublished but accepted papers along with the documents I submit right.

Few more questions not related to this topic.
1) I am a member in a scientific association. Do I have to request an official membership certificate from them or is a print out of my online profile in their website enough?
2) How many reco letters is ideal for a NIW case? I have about 4 from my work place+5 from outside. Do you think I should aim for more in these remaining days?

Thank you!
GL

Will Elsevier Researcher Academy certification as a peer reviewer and publication in ScienceDirect be considered for EB1A criteria by USCIS? Can you recommend journals that have a strong track record of being accepted by USCIS for EB1A applications?

Thanks,
