EB2-India June 2002, got his GC

hard to believe guys....looks like uscis is again into randomness....

remember i posted few days back( http://www.immigrationportal.com/showthread.php?t=197912 ) that my friend got his 485 approved...infact i misunderstood him....he meant to say his GC was approved...

he got his Green Card yesterday....THE CARD...

his 485 was apprved on nov 21 , his processing center was texas
 
techy, did you want to clarify with him if maybe he was approved in Sept 30

and it takes about 90 days to get the card

Wait till January 06 Visa Bulletine. There are two possibilities:

1. We may have cut of date June 2002 for EB2/India in Janu 06 bulletine

2. His/her case might have approved before retrogration came into force (Oct 1, 2006) and took some time to get GC card?

USDOS and USCIS may be working with unofficial - internal visa bulliton. USDOS might have given go-ahead signal for USCIS. Who knows?

Dec visa bulliton (official) says "Many of the Employment preference cut-off dates have advanced for the month of December. This is being done based on the amount of demand currently being received from Citizenship and Immigration Services (CIS) for adjustment of status cases, and consideration for CIS’s processing procedures and staffing patterns"
 
i confirmed....his 485 was approved on nov 21, and he got his card in 14 days..........all i can say is....screw uscis...but he is one lucky man..
 
we don't see even 98 cases yet approved, definitely 2002 cutoff everyone happy to see

i think since his is a border line case(sep-nov).....he just got lucky....his officer/center made the decision to give him the visa before cutoff was establish....

since EB2-india current pd is jul-00, i dont think its going to jump 2 years in one month...

as far as i know....uscis does not follow a order or rule strictly....if one is lucky...they can get favorable result..

or maybe....we were all wrong....and everyone with a approved 485 will get a GC....which is not what we are hearing on this forums.....
 
The roll back of visa numbers (to 06/2000 for India in EB2) may be due to very conservative approch by both DOS and CIS. This is because other countries shows "current". It means to me that lot of numbers are availble, but cases with that PD may not availble to approve. DOS might have set-up the arbitary date without knowing how many EB2-485s pending with PD before year 2000.

What I feel that there may not be any cases with PD before 06/2000 currently pending with USCIS. I feel 485 adjudicating guys sitting idle at service centers. They might have raised this issue with DOS. DOS might have issued some directions to approve the older 485s (without following visa bulliton). Thats why I am seeing some peoples going for interview also. This is my speculation.
 
If this guy got his GC, then EB2-India should move at least to July 2002 or this is another mistake by USCIS.
 
One of my co-worker's 485 with Sep 2002 PD got approved last week. It is hard to understand the logic behind retrogression and the working of USCIS. I just wish we were in a better and fair system. How can one understand the logic behind people stuck, first in states/federal and then in BEC for labor approvals for years and these organizations come up with PERM and start approving new cases without giving any consideration to the people waiting for years? How is USCIS justified in making people wait for their 485 approvals and completely working out of speculation that there will be a great demand of visa numbers?
 
ak_new_member : Let us know if and when he gets his card in hand. So the date should move to at least October 2002.

Hopefully soon - in a couple of months. (Assuming the co-worker is from India)
