EB2 Help ....I am desperate now

The job requirement was MS + 3 yrs or BS + 5 years. I could ask my manager and HR to make it MS + 2 yrs (that would be enough for Eb2 I guess, am I right ??)

I have 2.5 year FT experience of my home country and 2 years of Graduate Assistant experience (I did all computer related work in my GA which was very helpful for my current job and I could get letters from my supervisors at university supporting that)

I have MS degree but joined my company just 2 months earlier before my MS graduation.

I guess that I almostly fullfill job requirements and EB2 requirements.

But at joining time, I did not have MS degree (but my company knew that I would get very soon MS degree and just my project submission was remaining, officially I did not hold MS at joining time, I could get course completion letter from my dept.) ...

Should I file for EB2 or its just a waste of time ? I am from other countries so visa date is current for EB2. Is it worth taking chance?

My company is very top company of bay area and pay good money and is quite reputable. Does it help ??

The question is for you , not the company. Remember your MS is from the US. I don't know if there are such argument that complete all US MS course works is equivalent to US MS degree :) It is much much risky. If you want, you could try. You still have time (3.5 years on H1B), so if you lose this case (around 1 year to 1.5 year from now) , then find a new job to start again. Remember those USCIS people are not stupid.
Only if your MS is from outside of the US, you can easy argue with USCIS if you took more course work than those for the US MS.

Green card sponsorship is for a future employment opportunity on a permanent basis. According to USCIS, the alien beneficiary must have met all the education, experience and other special requirements stated on Section H of ETA 9089 form before the Filing Date (priority date) which is stated in Sec O of ETA 9089 form.

However, DOL may not certify a ETA-9089 form if they get the feeling that you are using education and/or experience gained while working for the sponsoring employer, to qualify for the job opportunity in Section H.
