EB2 Guess for India in Coming months

What are EB2 Moment in coming Months (April) for now

There is no point in guessing or polling. DOS is not following any logic in moving the dates. Therefore, our guesses will be waste.

I have done extensive analysis with available data. It is very clear that there is no demand in EB2 that requires to move the date is this much slow rate. DOS/CIS are having different calculations in their mind, that no one can predict. There is no correlation between what they say and what they do. They told to the lawyers assosiation that EB1 is consuming very fast and EB2 is going very slow. But they are moving EB1 date fast compare to EB2.

I am sure that, this year EB2 quota will not be completly consumed on 30th Sep 2006. The remaining numbers will either be given to EB3 or unused. It is very simple logic, if any one follow the last year statistics. In last year USCIS has done massive clearence in approving 485s. They approved 242,000 EB-485s. In last year,the entire 12 months, EB2 was "current" for all including India and China. Still they issued 44000 EB2 visas only, compare to 66000 in EB1 and 122,000 in EB3. It clearly shows there is no demand for EB2. In this year, almost 6 months gone. EB2 cutoff dates for India and china started with year 1999. Now it is still in 2002 which is 4 years from "current" date. India and China consumes more than 50% of total EB2 visa. One can easily assume now that how much numbers still unused at this point, as most of the labor still at BEC. They are still holding the dates for BEC to clear old LC, and not based on the pending EB2 485s. But their, claculation will fail if they still holding the date. I am very much sure that those who are going to file 140 & 485s after April 2006 will not able to get 485 approvals before the end of FY 2006 (Sep 2006) as USCIS typically need 6 months for approval of 140&485s.

Looks like USCIS wants to clear EB3

Guys and Gals

Most calculations (including mine) do not support slow movements of EB2 categories.

My guess ( I repeat guess) for slow movement for EB2 (for India) is that USCIS wants to clear EB3 fast - they are likely to let the EB2 quota to move to EB3.

My other guess ( I repeat guess) is that they are expecting a "significant" EB3 to EB2 conversion and are holding the dates for that reason.

The more USCIS/DOS behaves erratic, the more validity conspiracy thoeries take...hmmm.

I am very much sure that EB2 India and China is going to be screwed this year. Discussing this matter in the forum is not going to help us. The only way is EB2 folks sue the DOS/CIS, for their failure in allocation of visa numbers as per the rule and timly adjuicating the applications. Unless this happens, we can just scream here.
For example, you can easily understand how DOS working in allocating the visa numbers. The DOS offical who is incharge of visa allocation, told to an immigration attorney "While the First preference number use is relatively close to my target, the Second preference is significantly below my target which doesn't make a lot of sense"
If he just looked into the the last year statistics he would have not made this statement. The last year demand for EB1 was much more higher than EB2. This clearly shows that he has not analyzed how the demand pattern for various catagories.

Please do not quote DOS comments. Do you think that the March VB is implied what he said?.
They have all the figures and a game plan. They are working on it. No matter Visa number available or the PD is under retrogression. Most of the readers like me are just watching now the steps they are going to take.

We will win against Retrogression!

Legislative efforts will allow for filing of I-485 without Visa numbers - so it will all become a moot point!!! :D

where did you get this from? Is that your wishlist or something is really happenning
 
We all can guess but its all depends what USCIS guys guess. May be we should send our guesses to them to influence their guesses.
