Eb2/eb3 ???????

Hi,

I will be filing for my labor certification from North Dakota and have BE with 7 years of EXPERIENCE.

My lawyer says we should submit in EB3. I donno why cant he file in EB2 ?????

Can anyone please tell me the criteria to qualify for EB2 ????

I think your lawyer is right. Now a days BCIS is looking carefully at EB2 cases. And since priority dates are current it doesn't make any diff for you.

There's not much difference between EB2 and EB3 cases w.r.t. processing times. I think its only 1 or 2 months difference. Mine is almost similar to yours......your lawyer is right ...its good to follow his advice.
criteria for EB2 is: BE Degree + 5 years of experience or M.S. Degree. Hope it helps.

Your qualifications alone do not count. The job as described in LC should meet requirements for EB3. If the job calls for BS +3 years experience, then you qualify only for EB3. In any case, there is no real diference between EB2 and EB3.
