Hi, I saw the draft of form 9089 that my attorney prepared for my LC case. I heard people talking about EB2 vs. EB3 in this site, but I did not find anywhere in 9089 explicitly mentioning this. Can anyone tell me how I can tell which category my case falls into? And what is the implication? Thanks!

EB-2 or EB-3 comes into play when filing I-140 (that is the next step after LC).
You need to make sure your LC is such that it fits the category you want to apply under with I-140. If you LC doesn't fit the category your I-140 will be denied.

Thanks for the response! But could you please let me know how I can "make sure your LC is such that it fits the category you want to apply under with I-140"? My attorney has never mentioned the terminology of EB2 vs. EB3 to me. And could you please let me know whether I can figure out what category I fall into from the draft of 9089? Thanks!

It is based on your
1. Job requirement (Title and Prevailing wage)
2. Degree
3. Experience
Your PERM application need to say 'Master' or bachelor and 5+ year experience for EB2, otherwise, you are EB3
Have look at field F5 and H.1 to H.14 in your application that will tell you about this one.
