EB2, con-current filing RD Mar. 2003, PD July 2002.
I-140 approved in May 2004, on the approval notice it says "member of profession with advanced degree or person of exceptional ability".
I-485 status inquiry made from senator's office in Aug 2005. VSC responded: "visa unavailable". Contact senator's office again, pointing out that my case should be in EB2 and visa number is still available for Sept 2005 according to Visa Bulletin. Senator's office raised question to VSC
Begining of Sept, VSC approved I-140 again, they say "The I-140 was updated and approval for E21". Then found LUD changed for I-485 on Sept 8 and Sept 9, but status message not changed. Contacted the Senator's office and got a status inquiry response saying "the case has gone to the
clerical section and that you will be receiving some type of letter from
USCIS very shortly. VSC contact person could not tell what the correspondence is about."
Now this completely throw me in dark. I don't know what is happening to my I-485. 4 days after last LUD change, no email, no online status change, letter not received yet--don't know if it is mailed out yet. I am so frustrated, with this visa regression approaching. If it is a RFE letter, I need to respond it ASAP. Afraid that VSC just put is aside waiting for Oct. 1 to come
Guys, according to you experience and knowledge, what does the clerical section do? that this mean that the case was adjudicated by a officer?
