EB2 140 approved after RFE

My 140 is approved today after responding to the RFE.The details are as follows.
Concurrent filer
140 ND: 09/08/2003
RFE : May 13 2004 (Experience justifying EB2 category or Five years exp)
RFE recieved : June 10, 2004
140 approved: July 13 , 2004.
No FP.
485 --- ????????

Thank you all for your support,I was a silent observer on this forum.But I did my part of contribution to Immigration Portal some time back. Each cent from everyone of us can make a lot of difference.

As I said before , it is the benefit for this country to retain well educated professionals like us, who would build healthy society for future generations.

Could you please share your RFE Complete Details and what was your response to the RFE?

What was mentioned in your ETA-750 in Column 14 and 15?

I got a RFE too about Education Evaluation and Experience. Requesting to show Experience mentioned in ETA-750 which is Masters and one year of experience, i.e 6 years of experience.
In my ETA-750, Column 15 it is mentioned that Bachelors with 5 years Progressive experience will be accepted in lieu of Masters and 1 year of experience.

I have 5 years and 5 months of experience prior to filing the labor and joining the company.

My attorney replied that as the column 15 mentions, 6 years of experience is not required. He sent new progressive experience letters and education evaluation.

I-140 and 485 ND and RD 09/30/2003
RFE on I-140 06/07/2004
RFE response received on 07/06/2004

Waiting eagerly for a decision.

According to ETA-750 , the beneficiary may hold a Bachelors Degree plus five years of work experience to equal the masters degree. It is further noted that if Bachelors Degree plus five years of work experience is required to meet the educational requirement , the additional three years of work experience is not required.

The service has reviewed the employment letters of benefeciary's work experience.The beneficiary worked for
1) Company A for XX years
2) Company B for XX years
.....

The total workexperience accountable for the beneficiary based on the documentary evidence is XXXX years .

The beneficiary's ETA - 750 B cannot establish required work experience . Please submit evidence to establish that the beneficiary possessed the required work experience of xx years as of xxxxx date.

I got letters from all the employers I worked -- in one case the company went bankrupt , so got a letter from a co - worker. The attorney replied back with all the letters amounting to required work experience.

I think it all depends on the exact wording written on the labour application.
Further I heard from my attorney that these type of RFE's are trivial at 140 level. This should be caught at the time of approving the labour.

Please let me know if you need any more info.

Thanks for your reply. My RFE is similar to yours except that the adjucating officer is asking for 6 years, i.e Masters and 1 year experience. According to him Bachelors plus five years of experience equal Masters, so he is asking to show proof of the remaining 1 year.
It is mentioned in my Labor that Bachelors plus 5 years of progressive experience will be accepted in lieu of Masters and one year of experience. I guess he did not see column 15 and raised the RFE.
Even in my case one of the company is not there anymore, so even I had to give an affidavit from my co-worker. I hope mine will get approved too like yours.

about experience letter

For the experience letter, did you prepare it and ask co-worker to sign it, or ask co-worker to write it?

I prepared the letter according to the format given by my attorney and asked my co-worker to sign it.

I was following your posts regarding your experience and the RFE issued for your I-140?
Did INS accept the experience that you had obtained before the degree was awarded?
I am in a similar situation as you. I worked in a company for about 4 months and my attorney did not include that info in the LC/140 application. Now, if I submit an experience letter for that period, will INS accept it?
