Hi,

I called them up today, a nice lady answered that my case looks good and no issues at all. Everything was cleared and the processing dates and visa status also current for eb1 so she said that she was going to send an email to io to look into my case. She asked me to dall the NSC again in about three weeks to find out the status. Is there any other way to speedup my case. Please let me know.

Thanks,

485's Second RFE !!! - NSC

--------------------------------------------------------------------------------

Team,

My case was filled at NSC in EB1C. Please find the case details in my signature. I got a RFE for my 485 and wife's as well (Birth certificate) and replied on 09/20/07. Got 2 LUDs that RFE was received and other one no idea. Today I received three emails that they have sent one more RFE and need additional evidence on my case only (not for my wife). The RFE details receive from USCIS that...

Submit a written statement, on official letterhead, from the relevant government or other competent civil authority in India establishing that the birth certificate does not exist and/or is not available in that country. The statement must indicate the 1) reason the record does not exist and 2) whether similar records for the time and place are available.

Anyone of you have/had the same problem. It would be great help if you could respond so that I will prepare/get this doc from India and reply to my RFE.

Thanks in advance.

clarification

Could you please clarify a few things:

A) Which part of your message is new? The top part or the bottom part? I am assuming the bottom part is new
B) Please provide a bit more details on your RFEs... like what did you submit the first time and later on. What was missing in the birth certificate, did you submit any affidavits etc. etc.

Since there are quite people from India, you can expect a better response if you are clear in your request!

Hi Aroma Kills,

Thanks so much for your response. Here are the reponses to your questions...it would be appreciated for advice and help.

A) The top part of the messages is new one.
B) The first RFE they sent was requesting school certificate and no availability birth record document. I had to respond to that RFE within 2 days so I didn't have enough time to get the non availability birth record from India so my attorney has sent my school certificate along with my parents affidates. After a week, I received one more RFE (the same RFE) asked for non-availability birth certificate. I got this certificate from my local municipality office where I was born in India. I sent all these documents again (affidavits, school certificate and non-availability birth certificate) to USCIS on Oct 9th. My wife hasn't received the second RFE. Her first RFE was they asked her's I94 and 797c forms so her RFE response date was Sep 9th so its 60 days today. I called them today as per my previous message and got the response.

Could you please help me how do I proceed on this. thanks.

Wait!!!

I guess there isnt much you can do right now. You have sent in your RFEs and it appears that your security checks are clear. The agent has sent a request to an officer to look at your file. What else can you ask for. If the agent had done his/her job, then the officer should pick up your case, if he is willing. It truly is a waiting game. Just keep pushing them once in a while and then wait ;) I would not attach too much importance to 60 days etc. Do you have a lawyer? Ask him/her to do something as well.
