EB1-RFE for 140

Hi all! I received an RFE for 140 (EB1-OR) asking for the offer of employment, even though my University stated clearly that they were making a "long-term commitment for the Research Associate position." Is this a common thing to get an RFE on account of permanent position even though it is (almost) clearly mentioned in the offer letter? Does anyone have any idea what kind of letter I should furnish from my employer, ie, how specific? Thanks in advance, and good luck to you all.

that\'s not difficult

the letter from your university\'s dept/college or your prof is definitely needed. Maybe it was not that clear in the first letter you submitted. It needs to clearly state the following:
your title,full-time, permanent?
your salary?
the research projects you are working on; should be in line with your supporting evidence;
the role you play in those projects: few sentences would be enough on this point.

Good luck

Hi YCheng: Thanks for your suggestion. The problem is that this is not a permanent job, although my Professor is ready to mention it is a (very) long-term commitment, if that is needed. The question is, whether this would be enough without a specific date or mention of permanence. Also, the initial offer letter from the University was for one year, renewable for a longer period, but that hasn\'t expired yet. Do you think I would need a fresh letter with a bigger time-frame? Thanks for your help.

Your offer letter should have something similar to this:

"This contract will expire in __ years. Upon the expiration of this contract, the employer fully anticipates that it will continue to employ Dr. XXX full-time in the same capacity. Of course, this is contingent on successful completion of your responsibilities. This employment is thus of indefinite duration, and becomes at-will
upon the expiration of this contract."

I got this from an attorney. Basically you need an open-ended job offer. Good luck.

The problem may be from your title

As you said, the employment letter clearly said "long term commitment". However, INS might doubt about your "research associate" is a long term job. If your title can be promoted, plus an open end employment letter, that may be convincing.
