EB1 Prediction for India??

Any guesses from the forum Gurus on how EB1 for India will move in the forthcoming Visa Bulletins?

My I-140 is approved from TSC and shows a priority date of 22-Sept-2005.

If moves same as last 4 bulletin
In April Bulletin it will be Feb 05. I think it will Dec 04

I do not understand retrogression for EB1. EB1 before retrogression has average one year processing time. This means application filled before 2005 must have cleared before retrogression. EB1 new approval will come when date will move to 2005. I do not understand the way USCIS calculate the number and hope in next four month it will move by one year. Although there was a red signal given by USCIS in one of the news conference. They indicated more EB1 application than EB2. If it is true it may take 8 months to move one year form current date.

EB1 retrogression for China & India is probably due to the limit of 7.5% each country on the total numbers, but indeed it does not make any sense. There have been only a couple of Nobel Prize winners from China and only 4 from India, and they are probably long gone - :rolleyes: they are not lining over for GCs that I am aware of. Just kidding, but there are other great EB1 candidates from these countries, of course!
The EB1 retrogression is inexplicable! :confused:
 
I think retrogression in EB1 is partly due to FBI name check. Many people are stuck there.

i think there is a new breed of EB1 called as managers.....i am not very sure of this.....but very senior people can get their case filed as EB1 under manager category.....

i had heard from my friend that his company may file his petition under EB1 (he is originally EB3).....that may make things worse in EB1 because i think almost 20% of the current EB3 & EB2 can qulify as multinational managers..

New member, advise and help EB1

Hi,

I am a new member and currently in a academic faculty position to file for a EB1 - outstanding researcher.

Having read some of the contents in this and other threads makes me wonder of i know all what i need to know before i file.

1. i am advised to get 7-8 reference letters and have to draft them but feel unsure of its contents (although i have few sample letters)

2. I will hopefully send my application in March-April 2006 and not sure what the priority dates retrogression really means.

3. i have to send my ap to the Vermont SC , i guess that is the slowest!

4. My university is preparing this application but i am not sure if i shoud entirely rely of them. Hence wanted to find out from people who have done so and are from India.

Could you please send me some advise and suggest where i can find more information. Also guidance of recommnedations etc will be very helpful.

also try to prepare the application and compile the documentation yourself as much as possible since the university staff may not be as careful in organising the document as you.

do not worry too much about retrogression....since EB1 is least affected.....but it means that you can only file I-140 right now.

Multiple RFEs?

Hi Gurus

Just a curiosity question. Anyone has idea if there can be multiple RFEs for an I-485? What I mean to ask is say if someone recieved an RFE and this has been replied (correctly) and is there a possiblility of getting another RFE for different reason?

This is to ascertain if USCIS requests all the information in a single RFE or might issue multiple RFEs spanning different periods?
 
EB1-India filed in Feb 2005 - now what?

The April bulletin says that the PD for EB1-India is Jan 2005. I filed my application in Feb 2005. Assuming the date becomes current by next month, when can I expect to see the greencard? Thanks in advance.
