Hi:
My current employer has filed for EB1-OR recently. But, they refused to provide me copy of application or receipt citing it is company's property (company's policy, what else?). I have another very good offer which I would like to accept. What happened to my application if I move to another company? Can the current employer retract/withdraw my application? How can I know the outcome of my application? Do I have to restart my application?

I will appreciate any comments/suggestion.

its definitely company's property.........but i think you do have some right to know about the process since it involves your life....you can use this reasoning with the concerned person.........also i would recommend that you try to get the receipt number of the I-140 application so that you can check the status online...

i will suggest that you take it very slow and easy since EB1-OR is not like other categories.....since you may need another set of recommendation letter to file another GC application....

btw....what kind of company is it?, i used to think EB1-OR is usually done by a research based company which are as big as nasa, intel etc....or by universities.........and these orgs are usually pretty transparent about the process...


without co-operation from your employer you will never know whether your application was really filed......you will have to let them know that it is your right to know about the process...

As it is EB-OR, if you change your employer, your application will no longet be valid. You have to stick to your current employer until you receive your GC. I am not sure whether you can file another petition through your new employer in the SAME category. Other experienced members in the forum may help you with that.
 
Well, it is one of the large high tech company. They are transparent in many ways. They will give me the receipt number and all that, but they will not give me a copy of the actual application materials.

I used to think EB1 category is independent of employer and not an employer-specific application. The new company is willing to file it again, but it will slow down the process.

My question is what happens to the approval notice (if it comes)? Can I get a copy directly from USCIS if I have the receipt? Can the employer get that cancelled?

Your input is greatly appreciated.

They can sure cancel it if you leave the company before getting the greencard. Wait for 180 days after filing the I485 if you could. otherwise, you are going to start all over.

by the way, do you have three years experience after ph.d. graduation?
