EB1-OR: Two questions

My University international services filed EB1-OR on behalf of me (I140/485 RD 6/23/04 FP). My qualifications: Tenure-track, 3 publications, 8 invited talks, 6-7 conferences, 3 citations, 2 national awards (American ..... Association), 11 recommendation letters (3 from independent scientists, 1 from boss, 3 from Phd. advisor and committee members, 2 from scientists from other discipline I collaborate with and 2 from my ex-professors), 3 reviews, and some awards from the time of my Ph.D. education.

Question 1: Where do I stand in terms of OR-qualifications?
Question 2: Recently I received 3 more invitations and Who's Who in America citation for 2006. How do I send them to USCIS?

1. Sounds very good. I believe you fully qualify for this category.
2. You might submit these letters if you get RFE, but I doubt that you will be asked for more evidence. I think that you are gonna be fine for this category with what you already submitted, but of course, you may get RFE. You can not just send invitations without a request for evidence from CIS, and I also believe that those invitations themselves do not mean much, it's better to have your biography actually published in Who's Who. My biography has been also published in 2005 book, and I submitted a copy of the book page with my biography and a letter from editor stating that it's published because of my outstanding achievements and stuff with my original petition. It worked for me, but I read that some other people got questions from CIS about the value of such a publication. My overall feeling is that Who's Who publication itself does not carry much weight and might be used only as additional, very last "sexy" exhibit.

Hope you will get approved soon. The best of luck!

Gpng has a valid point. Who's who is more considered a Vanity Press by USCIS. My biography appeared in their Who's Who Sci and Tech, America and World.

Since you have teaching position, I think you would have got faster LC approval and consequently I-140 and I-1485 approval. I have heard that LC comes in less than 6 mths (where LC normally takes years to come through) if you have teaching position in Univ.

I think your qualification perfectly suits for OR. In my opinion, there won't be any problem as long as the application package is properly presented to USCIS.
Good luck!

It used to be the case. My colleauge (joined at the same time) applied for "Special Handling" LC in May 2004 and her's was approved in August 2004. I applied in September 2004 and My case was shipped to Backlog Center (where, I believe, there is no queue for Special handling). So unlucky, me!

Thanks a lot Gpng, Toxsci and Sandy. I hope your wish becomes true about no RFE. I will save these evidences for a potential RFE unless they deny it straight.

I think you should try to get as many letters from independent letters as possible. Possibly the guys should be big Guns. Also, I would recommend that take only one letter from each institute/ univ. Normally USCIS discounts more than 1 letter from each institute. Check AAO decisions. What is your area of expertise? Based on your qualifications, I think you would satisfy

1. Permanent job offer
2. Awards (I hope they are not fellowship, grants, best poster etc.)
3. Research Publications (peer -reviewed)
4. Judge of others..
5. Citation: Have the cited authors specifically mention your work or name ( I think just 3 citations are less)

Typically any accomplishments after the submission of applications are discounted by USCIS

Best wishes

1) Looks reasonable for OR but you should try to get more 3-4 independent recommendation letters

2) Any evidence appearing after sending the petition doesn't count anymore (i.e. new publications, poster etc.) And forget the Who's Who crap that is absolute nothing to establish your oustanding achievements but just a joke.

Sandy and Honkman,

Thanks a lot for your suggestion. I will be in touch with some big shots to see if they are willing to write for me (assuming they will at least issue an RFE before denying it outright).
