Hi everybody!
Please help me, I need to know if I have to submit ETA - B for EB1/OR
along with all documents with I-140 form required.
Very much appreciate your help:confused:

ETA

The form is ETA-750B. I had filed it with both of my I-140's (at lawyer's request). Some people say it is not necessary, though. It essentially summarizes your credentials.

750b

as far as I am aware - eta 750B does need to accompany your petition. (I submitted with my eb1ea and eb2 niw)

ETA 750B

and yes, even I never heard of ETA 750 B way after I myself filled it out and filed with my petitions!! (the ETA 750B is in small print somewhere on the form)
Do'nt be to gullible of some comments/suggestions on the forum. Find out first hand for yourself from a good attorney, INS site etc.

Your are very right about attorney, but thing is when I 'd consulted with two attorneys about this form, I 've got two opposite recomendations. One recommend to use ETA 750B, another consider it for OR irrelevant. As I understand you are/were applying for EA and NIW, these are kind of different from OR. In INS www said nothing about OR, but required this form for NIW(my guess for EA also).
I have a question, have you submitted evidences in duplicates for your petitions, because if you submitt ETA 750B, you have to include the same evidence as for I-140 form, for example papers, copies of degree etc.
Thank you!

evidence

I-140 and ETA 750 B filed for one category (same petition) would obviously require only one set of evidence (personal opinion only). By the way I wonder why would including 750 B for OR hurt - plus its pretty straight forward form --- also as far as I am aware - where it says to list prior jobs/experience etc one can just mention "refer attached CV" - BTW, do you have an attorney doing all this for you or are you doing it yourself? (I went through an attorney - so I am just telling you what he did for me)

Thank you for reply!
I am consulting with attorney, but mostly doing it by myself. BTW, one of them said that for NIW including ETA-750B is obligatory and evidence should be submitted in duplicates. It will definitely don't hurt an application, I just wanted to figure it out and send the correct package.

evidence copies

I am really not certain - you should check with couple good atorneys and what you deem necessary (I have no legal expertise)

"Exemption from job offer. To apply for the exemption, the petitioner must submit Form ETA-750B, Statement of Qualifications of Alien, in duplicate, as well as evidence to support the claim that such exemption would be in the national interest. "
This is exact phrase from INS web site about documentation requirement for "Aliens who are members of the professions holding advanced degrees or aliens of exceptional ability, section 203(b)(2) "
Maybe it will be helpfull for you? As far as I understand you should care also, not just your attorney.

hi

Thanks for the verbatim quote. As I said for my EB1EA and EB2NIW, eta 750B was filed. As for duplicates for 750B - the attorney files too many in these categories - so atleast for this I trust that he did the right thing. But I will double check to make sure. From the quote you posted it seems you do not need to file for ETA750B for EB1OR.
BTW, I do proofread all the forms etc that the attorney submits as once a while I have caught mistakes, but some details (ie # of copies to be submitted etc) I have to leave to the attorney - after all why in the world would I be paying him.
