I was wondering if anyone has had success with filing for EB1 OR petition through a startup company. My understanding is that since EB1 OR is employer supported petition, the following requirements are critical to the application (apart from employee's credentials) :
1) Atleast 3 researchers working full time + documented research impact of those 3 researchers through the same employer
2) Permanent job offer to the employee in research capacity or with research impact
Even though the company can prove (1), I was wondering if INS differentiates between research done at a startup versus done in a bigger company. Also for (2), I am concerned that even though the startup is stable and has funding, if the permanent job offer requirement could be a problem since its a startup.
Any inputs or insights, from personal experiences or otherwise would be appreciated.
