EB1/OR and EB1/EA concurrently

Hello,

I am considering applying for EB1/OR (through my employer) and
EB1/EA (self-petition) concurrently. I have a few questions:

1. Can I file my I-140 for EB1/EA after the I-140 for EB1/OR
has been approved? If so, can I file my EB1/EA I-140 after the
EB1/OR I-485 has been filed?

2. In the event of the EB1/EA petition being turned down, what
impact, if any, is there on the EB1/OR process (EAD, I-485, etc.).

3. If EB1/EA I-140 is approved, can I elect for consular processing
if I choose AOS for the EB1/OR application? If not, can I kill the
EB1/OR application and go with the EB1/EA application instead?

Thanks for any info.

You can file the two petitions simultaneously. No problems.

That should answer all the three questions.

Good luck.

I just called the INS National Customer Service Center
(800-375-5283). They told me that one *cannot* file more
than one I-140 petition. One can only withdraw one application
and then submit another.

I am confused because the posts on this discussion board
indicate that people have (successfully) applied for
EB1/OR and EB1/EA concurrently (though I am not sure whether
they waited for one to be approved before filing the other).
Can someone clarify? If you know of good lawyers who have
successfully prosecuted such cases, I\'d appreciate having
their contact information.

Thanks.
