EB1-OR and EB1-EA. A very good Suggestion and Do I Qualify

Guys,

My company already filed an EB1-Outstanding Researcher
Petition for me.

However, with the down turn in the economy, employers
are starting to behave less than diplomatically, since they
now perceive themselves as having the upper hand. I have no gripes about
this, it is capitalism, which I have benefited from immensely over
the last 2.5 years. My advice is, if you have an EB1-OR then
try filing for an EB1-EA due to its portable nature.

My questions is, do I qualify for a self petitioned EB1-EA.

. Ph.D. in computer science (Overseas)
. 2.5 years in U.S. in industrial research labs and companies.
. several national awards
. 1 Patent application
. 13 papers in conferences (no journal papers).
. Not many citations.
. Reviewed for a journal and a few international conferences.

Will give you the courtesy of being blunt:
I don\'t believe your record would now quailify for the EB-1 (EA)
based on your description, unless your national awards are up there with the Fields medal or close.
And, as to your next question, to salvage whatever marginal chance you may\'ve got, you\'ll need a superb legal effort (that will likely cost run into sizeably above 4 K - more like 8-10 K total).

I asked a lawyer if I qualifed, he said
I probably did, but I want other opinions.

Has anyone who has submitted (or preferably)
had a EB-1 EA petition approved like to
give us their experience details.

Jose Latour (www.usvisanews.com). He\'s reputed as one of the most
conservative lawyers in the EB1/NIW field. If you do, would appreciate your posting the results.
