I got a RFE for my EB1B(outstanding researcher) and responded 5 months ago.
They asked about job permanency ( mine is a permanent staff scientist position). I got a joint letter from chairman and Dean saying it is permanent.
ALso they needed more information to support my application as an outstanding scientist. Got a letter from a Nobel Lauerate and sent the updated citation index and recent publications etc. Been 5 months and no response from NSC. What are my chances of getting it approved? thanks

It is really creditable to get letter from Noble Laureate!!! Was this Noble Laureate working in your field? Did he say you are the best researcher ? If so then he should pass down his prize his prize to you :) Just kidding. I think you have 100 % chances.
 
Thanks for your reply. Yes, nobel prize winner is working in my field of research and he wrote a strong letter. I wonder why it takes 5 months after the response to the RFE! If i file 485 now, will it be considered as a concurrent and will it be approved along with the 140? When I filed 140, i was single and now I am married and planning to file 485 for me and my wife soon. ANother few yrs for 485 approval!
 
USCIS has rescinded the concurrent approval policy some time back.. Nevertheless there are still sporadic instances of concurrent approvals coming out of service centers other than NSC.

Could you please share some of your qualifications like publications, citations, memberships, awards etc. that you claimed for the OR classification.

Ideally it should not take them 5 months. Did you file RFE yourself? Make sure that your RFE was received by the NSC. Did you follow online LUD on you case ?

If you file I-485 now it should be considered as filled concurrently. Actually, it is a good chance to file you and your wife to file I-485. It take time for NSC to generate fingerprintting notices and update your file for processing your Green Card. You never know NSC may find your file uptodate approve everything. I have generally noted that service centers give more preference to cases filed simultaneously. So dont wait for long time. It is possible that I-485 filing may urge the Center Administrative Officer to look in to you pending I-140 case too. EB1OR is something that one can never loose. Only few lucky ones like you get that All you need for EB1OR is a permanent job offer. Goodluck and dont worry.
 
Thanks for your replies. Let me share my qualifications and credentials.
I have a Ph.D in Biophysics from India. 3.5 yrs of post-doctotral experience (in europe and in USA). Have 7 published papers including one in Nature. Have more than 55 citations by the scientists from more than 10 countries including the top schools in USA such as harvard, MIT, Caltech etc etc. Two nobel lauraetes in my field cited my work.
Had a grant from an european science foundation during my post-doc yrs in europe (to support my salary and research expenses).
 
thanks. No, my employer responsed to the RFE (I prepared the response letter with tons of supporting evidences). They received my response sometime in Jan 2005. I checked the status it said they did. We called the USCIS and they sent a letter saying due to the pending caseload it takes more time than stated in their letter. Any suggestions?
Any EB1B Outstanding researcher approvals from Nebraska recently?

My frind filed OR at NSC 9/2004 and got approval 4/2005. However, I filed 5/2005, after replied to RFE 4/2005, now waiting. :mad: How many days they said they need to process your RFE in their online message? Mine says 150 to 180 days. Is this the same as yours?

Yep, 150 to 180 days. but since the intial processising is complete it takes less than the stated time. but it has been 150 days for my case after they received my response for rfe. waiting! mine is non concurrent..maybe thatswhy it is delayed..

COngrats Streamflow. I was told that mine will be decided very soon and they already assigned my case to an officer in april ...praying she will get into my case very soon.

5 months over afer the rfe response

160 days are over after NSC received the response to the RFE. Waiting with hopes. EB1 OR

I got an RFE request in December for my OR application. The reviewer questioned every single item I used to prove my OR status. 3 months later we finally sent in that response and a week later my application got approved.
