I have Bachelor with 5YRS experience. I want to file under EB2 as requirement is Bachelor + 5yrs experience. However, I just found out that, my 1yr-experience pre-graduation cannot be used toward EB2 case. So basically, I am now Bachelor with 4yrs experience (1yr short).
Attorney suggested:
OPTION 1. Assuming money is not a problem, just file EB2 now, if INS doesn't notice, I may have a chance to get GC faster. If INS noticed, we will withdraw and do another promotion or demote to EB3.
OPTION 2. Wait for another 1yr until I have true full 5yrs experience and file EB2.
Attorney prefer OPTION 1 as it increases chances to get GC faster. Anyone can share opinion?
