I am currently in india and per USCIS, my I-140 was approved on Aug 10, 2011.
Right now I am exploring an option to change employer and in that regard, I recently talked to another employer who is in US now.
He said...
1) I can plan to travel to US by filing H4 visa because my spouse is currently in US on H1b
2) he will be able to file I-485 in US based on my approved I-140, only after 6 months are elapsed from I-140 approval date.
3) he will also immediately file a H1B application based on I-140 approval..Once approved, I can start working immediately in US (by switching from H4 to H1)
I need to find out, whether this is legally doable? If you see any potential issues, please alert me.
Or is it advisable to stick with current employer for executing next steps after I-140 (via consular processing)?
