we are applying for an eb1 after having received an O visa for 3 years based on EA. My husband works in a cutting edge field on wall street and his O visa came through in 3 days with premium processing. We are trying to decide what our chances are with eb1 and also if we shoudl file concurrently. Our lawyer says that if we file concurrently and for some reaosn I140 is denied, we will have to leave the US on the day of the denial and go back to home country for a new visa stamp or we will be out of status. Any thought will be greatly appreciated. REally. Good luck to all of you out there.

Interesting - not sure what cutting edge wall street is, but i got eb1-ea off a o-1 back in dec02 in VSC and my EA was combining STP, associated tech, and legal around it applied to financial services- with proven experience credentials etc. But certainly not a traditional one compared to what I read here (which seems to be more stricto sensu scientific) - my dates are tracked under Hubert on cptracker.com.
