EB1-extra ordinary got rejected 4 year ago, can I re- apply now?

Dear all,

My c.v. got much better (lot more publications, awards and presentations) and I would like to resubmit my I140 under extra ordinary category.

Has any one tried this before?

I have approved I140 under NIW, but looks like it is going to take for ever.

You can apply and reapply however many times you want as long as you are qualified. If you have more qualifications now, there is nothing to prevent you from filing again. Each case is judged on its own merit.

It will be great if you can comment on following part of the I140

1. check here to amend a previously filed petition -Receipt number----- - I guess, including the rejected petition wont help?

2.Has any immigrant visa ever been field - I include my current I485 and NIW numbers?
 
I was in your position. I declared everything...including my previously failed attempt at getting EB1, and also my 485 which was pending based on approved NIW. They did approve my EA petition though. I would suggest being honest.....if you dont mention your previous attempt, i am sure they can easily find it out.

Thanks a lot! It feels good to hear this. Did you use the same recommendation letters (I just dont want to disturb everybody again..)?

What do you think helped you most, the second time?

can you give me some tips advice suggestions?
 
previously i had submitted about 9 or so letters i think. this time, i added one more new one. for the old ones, i got permission from them to change the date, and i simply changed it myself, in som cases, the guys were nice enough to do it and send me a re-dated version.

The first time, i had gone through an attorney, the second time, i did it on my own...i took care in writing the memo so it answered all the tough questions i had got on the RFE the previous time. In the end, the difference was really that the first attempt went to NSC, the second went to TSC. That was the clincher.
