EB1/EB2 Question...

Can some experts shed some light on this Question?

I was always under the impression that, EB1/EB2 classification matters only in the Labor Certification stage.

But, a friend of mine told me, EB1/EB2 matters in the I-140 as well.

Please help...

No. I asked my lawyer about this, and she said EB1s and 2s don't make any different about order or speed of 485 processing. After all, it is just the adjustment phase. The 140 is where it matters because there are different burdens of proof for qualifications in those categories.

There ARE some factual differences about the categories though. For example EB1-EA, if self-petitioned, does not require the applicant to have a job offer, or even a job, so an RFE for EVL, etc. would not be issued.
