EB1-EA through employer

What are the pros and cons of filing under the EB1-EA category through the employer?

I migh be eligible for the EA category based on my work with the employer (not an academic institution). I am not sure if I should go and hire an attorney to do it or go after my employer to do it.

On a related note - I have already filed under EB2-RIR labor through my employer, pending approval. Is it still possible to consider filing under EB1-EA, given my EB2 LC is pending?

Any late 2004 EB1 - I140 approved?

By definition the EA category is employer-independent, ie the application is submitted on the behalf of the petitioner rather than on behalf of the specific position holder (OR or MEM). However, if your employer is ready to pay for it, you can have the lawyer file and EA on your behalf and extract the payment from your employer. This is exactly what I did.
