EB1: EA or OR

Hi,

I am new to this, I appreciate any comment

Credentials:
PhD in Electrical Engineering.
publications (8 journals, 20 conferences) all in very reputable journal/conferences.
Reviewed some Journal papers (different journals and conferences),
No major prize,
15 recommnedations (10 Schools, USC,UCLA,CALTECH,PRINCETON,UC DAVIS, PERDUE, 5 Companies Manager Level)
one US patent,
Membership: IEEE, phi kappa phi, OSA

I wanted to see if any one has opinion about risk factors of EA vs OA. I would rather to apply without a sponsor which leaves me with only one category which is EA, but I would like to check if the risk is a lot higher that OA.

I would also appreciate suggestions on possible RFE and how to fill those gaps.

Tell us number of citations too. Are you first author everywhere? 8 journals is not Extraordinary unless they are all top in the field.
Your other criteria look weak. What is your current job? do you get v high salary?
 
Hi,

My Citations are limited, each paper around 7-8 citations, 3-4 of them self citation. I have some of them cited by a book and a couple of PhD thesis. Most of the journals are published in 2006, so I can not expect that much more.

I am first author in4 of the journals, and first autor in 10 of conferences.

One Journal, second author of an ivited paper. One firsr author post deadline paper, which is considered big, because the acceptance ratio is less than 10%.

Papers are all published in the highest ranked journal and conferences of IEEE and OSA.

My salary is 100k, I don't know if it is considered high salary

How wouls you see my chance if it is filed well,

For EA, it is going to be difficult as there seem to be only two criteria you could claim (papers and contribution to the field), with publications not very strong.

For how long have you been working in your field?

Although he you can claim "judging others work" as third criteria (if you have reviewed large numbr of papers), publications and citations does not looks extraordinary. Definitely it is a strong EB1-OR case providing atleast 3 yrs of experience following Ph.D.

I do not have 3 years of experience after my PhD, so the question now is if I should followup with EB1 EA or work on NIW , or even both of them together. Let me know your suggestions.

Can I make a case for NIW?

You don't need 3 experience after Ph.D. Since you have good publications in your graduation, you can claim PhD work as outstanding. Lot of people got EB1-OR without 3 years of experience after PhD. If you have done your PhD more than 3 years-that is sufficient.
 
NIW petition requires more effort

It all depends if you can succesfuly argue all of these
  1. it must be shown that the alien seeks employment in an area of substantial intrinsic merit,
  2. it must be shown that the proposed benefit will be national in scope
  3. the petitioner seeking the waiver must persuasively demonstrate that the national interest would be adversely affected if a labor certification were required
  4. aliens ability to serve national interest is significantly above than available US worker with same minimal qualifications
  5. alien has a past record of contributions to areas of national interest justifying future benefit to national interest

Now EA,OR or NIW ?. EA is most demanding in terms of credentials, while it is less demanding (relatively) on preparing the petition. While NIW is less demanding in terms of credentials, it apparently is the most tough to argue (especially clause (3) above). If you search web, you will find most people opine that NIW needs a careful petition preparation by an experienced attorney.

Seems to me that if you have a permanent job, EB1-OR is a safer route than NIW.

My suggestion (I haven't yet submitted my NIW yet. So, I am not really experienced): If you have good credentials, go with EB1-EA, or EB1-OR. If not, try NIW.
