Folks, please help me decide if I should apply for EB1-EA?

- PhD, Chemical Engineering (US), 2006. All of the graduate and postdoc work was done for DoE, DoD, NRO, US Army, CIA and NSF. Currently working in a national lab on energy security.
-12 Journal Articles (81 out of the loop citations, h-factor=5), 2 Transactions/proceedings papers, 1 Encyclopedia Article, 1 Magazine Article, 25 Conference Presentations, 2 Invited talks
-Ad-hoc Reviewer for 9 Journals (68 manuscripts reviewed so far); Organized or co-chaired international symposiums in my field since 2007.

Do I have a chance?

-Have won student awards and also a member of Sigma Xi but have decided not to use them.

I have asked for opinion in this forum a year before and my citation count was not that great (~30 at that time) and did not have considerable reviewing experience. Several senior members of this forum suggested at that time to wait for some more time or go for EB2-NIW. I didn't want to go EB2 because of the obvious retrogression reasons. It was backlogged at that time too. Now that my credentials have slightly improved, any of you think I have a chance here? Thanks in advance for your time. You guys are great!
 
You seem to be in a similar situation to mine, except I am a few years further down the career path. Chemical sciences seem to be viewed very poorly by immigration officials. I have been surprised by the negative reactions to my suggestions of seeking a green card. In my time I have worked on projects funded by DoE, DoD, NSF and four major US corporations. However, whenever I seek advice on permanent residence the consensus is always that it would be either impossible or extremely difficult to obtain. It has even been suggested that I should focus more on medical aspects of my work in the future to stand any chance of approval.

Your resume looks a lot stonger. But dont you hve to meet atleast 3 criteria under EB1EA

1.Your Journals/Projects/Articles cover research criteria

2.Chair of symposium and Reviewer of Journals cover the Judge of the work
done by the peers (68 reviews is very impressive)

You will have a very tough time satisfying the third criteria.

Weaknesses:
Awards=0 (student award woulnt work)
Memberiship of Professional Org by Invitation=0 (Sigma Xi is too common)
Published articles/work about you by others=0
Higher Salary than peers=Can you prove it? Usually very hard to prove.


Conclusion:
I absoultely think that you have a very impressive resume. But I do think that you will hve a tough time convincing that you have Exceptional Ability. I am puzzeled about why you dont want to look for EB1-OR? I believe you would get it very very easily. Unless your employer is not willing to cooperate.

Yes, I think you have a reasonable EB1-EA case and it is worth trying to apply. It is fairly clear that you satisfy two of the EB1-EA criteria: having been a judge of the work of others (based on your refereeing work) and being an author of published scholarly articles. You can also argue, based on citations of your work, for satisfying the criterion "Published material about the alien in professional or major trade publications or other major media".
Finally, although this is a tougher sell, you can try to argue that you satisfy the criterion "Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field".
You'd need to get about 8-10 strong letters from top experts in the field for this.

All in all, I think you have a reasonable chance of success with an EB1-EA application. Another point is that now premium processing is available for EB1-EA applications, and if you use it, you will get a decision quickly. If your EB1-EA is denied, you could try EB2-NIW then.
 
Thanks Baikal for your encouraging advise! Other senior members also pointed out the citations aspect and asked me to wait a bit. I'm more interested, like you said, to apply now because of the premium processing option being available. Not sure when it will be closed. Thanks again!

AMD, yes, in exactly similar situation but I would think that you have a lot more publications and a lot more experience than me. Plus you are from a non-retrogressed country. So, you can take advantage of that and apply in both EB1 and EB2 categories.

And JGK, thanks for your reply. I'm not eligible to apply for EB1-OR because of my employer's policy not to sponsor short term/visa based employees. That's why I'm looking for self-filing options like EA and NIW.
