EB1-EA Case

Hi all: This is my first post here at Immigration forum. Thanks in advance for helping me out!

I'm currently a postdoctoral researcher in a national lab (that does declassified research) working in lithium ion batteries. I'm currently on H1B (non-profit) and preparing my EB1-EA application. Here is my case:

1. Serving as a judge of others in your field either individually or on a panel:
-I'm a journal article reviewer for about 9 journals (most of them have good impact factors~2.5 and above) and have reviewed ~22 manuscripts in the last 10 months
-Judged student poster competitions in several conferences


2. Authorship of scholarly articles in your field.
-8 journal articles (5 first author, 2 second author, 1 third author), 34 citations.
-1 chapter in an Encyclopedia
-1 book chapter
-1 magazine article

3. Original, scientific, scholarly, artistic, athletic, or business-related contributions of major significance in your field.
-My PhD was on hydrogen fuel cells and elucidated mechanisms that cause the them to fail. Can get good recommendation letters from well known authorities in this area.

4. Membership in associations in your field that require "outstanding achievement" of their members.
-Sigma Xi (others are just regular fee based memberships)

5. Receipt of a lesser nationally or internationally recognized prize for achievement in your field.
I have a student award from a major society but not sure if it counts

That's it. I have the following questions:

1. Should I go for EB1-EA or go for EB2-NIW or both? What are my chances? Both my PhD work and my postdoc research are energy related and I think NIW case could be stronger.

2. I only have 2 years of post-PhD experience. I read that there is a 3 year requirement before one can apply for EB1-EA - is it true. Should I wait for one more year before I apply?

Hi: You could try for both but you have stronger case for NIW.
Citations might be lower for EB1-EA. You don't need 3 years post-Ph.D. experience for EA but required for OR. Sigma xi and student awards won't count.
