Dear All
Thank you so much for the info I got here. I just noticed that the USCIS sent an email approval notice on Nov. 30. I just saw it today Dec. 14. (talking about lax email habbits). Now, my questions are:
1-What do I need to do next?
2-Is there a deadline for doing the next step?
3-I am out of the U.S. right now and won't be back before Jan. 17. Will this be a problem? Do I need to get back to the U.S. for everything to work out fine?

Thanks a lot. Hope to hear from all of you soonest.
:) :D

Congrats on your approval.
1- If you are by any chance subject to a home residency requirement because of a current or previous J-1 visa, now is the time to apply for a waiver. If not, then you should apply as soon as possible for adjustment of status, which requires a bunch of paperwork including a medical exam as well as applications for work permits and travel permits, if needed.
2- Since you are EB1-EA there is no deadline BUT that may change at any time, especially if you are from India or China. As of now, January 2007 is open for application, and each successive month will be known around the 12th of the previous month (so we will know if February is open around January 12th), it seems likely that February will be open as well.
3- I assume you have a valid visa? Are you already working in the US? If so, it is much better for you to start everything once you return. When you filed your (now approved) I-140, did you indicate whether you were going to adjust status inside the US or do consular processing from abroad? The answer will determine where you will need to start from, although I think doing it from inside the US will be much more beneficial.

Congratulations

Hi emekay
Congratulations. As mentioned by the other person come back to US and file your 485 as early as possible. I presume that you have a valid visa to come back to US. EB1 is likely to be current for February. Can you make it to get all the paper work done within a week (only medical might take some time)? If so you could file your 485 by February end. Nobody knows whether it will remain current in March. You would come to know by middle of February. If it remains current for March also then you will have more time to file your 485.

It would help a lot if you include your case information as signature.

Meanwhile have a great vacation.

Thanks All

I am not from India or China. I do not think I am from a retro country either. I self-petitioned and I opted for filing from inside the U.S. I and my wife have valid visas till May 2007. I am on H1B and she is on H4. We'll be back in the U.S. by Jan. 17.

EB1-EA applied on 10/18/2006
Approval Notice via email 11/30/06.
Saw the notice just now :D

That's it. I hope that's useful. So you guys think it's ok to wait till Jan. to apply for the I-489. Right?

Yes, as soon as you get back, make an appointment with a civil surgeon for your medical exam. Bring any previous vaccination records with you to the civil surgeon. In the meantime, download and fill out forms I-485 (one for each). If your wife wants a work permit, then download and fill I-765 (another for you if your H-1B expires in May). Also download and fill I-131 for each so you can travel abroad after your visas expire (you can wait to fill I-131 later if you like, it takes ~3 months to get the advanced parole). Each of these applications require 2 photos, so you might need as many as 6 photos each. $395 for each I-485, $180 for each I-765 (employment authorization), and $170 for each I-131.

TSC or NSC

Hi emekay
Which center processed your I140. Also could you briefly post your credentials? This would others in the forum. Thanks.

i do not have academic credentials per se. i am an international journalist. i interviewed top u.s. and international leaders and have covered news stories in hot spots around the world. i included 12 reference letters, some of them from top professionals and academics who used my work. my work has been translated into several languages. i won two u.s. journalism awards. i appear regularly as a commentator on international and u.s. tv networks, radio shows and newspapers. these are briefly my qualifications.

i organized my papers very well. worked really really hard on them. included impressive pictures with top world leaders and copies of my tv, radio and newspaper interviews. let me know if you guys have any questions. i’d be glad to help for sure.
