Hi everyone

I need some advice on filing for EB1-a. Have consulted three lawyers, two said my case is strong and third told me to wait for 6 more months.

Here are my credentials:

1. PhD from UK (worked on new emerging food processing method)
2. Have post doc experience in US (18 months)
3. 14 Refereed Journal Papers (13 Published, one submitted), 10 first author
papers with 54 citations out of 10 Papers (including 6 self citations, rest
three papers were recently published).
4. International Awards for Phd, Travel Awards for research work and won
many scholarships throughout my career.
5. Reviewed almost 5 papers for Journals
6. Professional Member of prestigious organisations in my field
7. Attended and presented at conferences.
8. Can get recommendation letters from known professors (UK, India,
Denmark, Ireland and USA) and some unknown people working at Federal
Govt Labs in USA

I would be grateful if someone can advice me on looking at the above.

Thanks so much and wish everyone a good luck

Regards
Lakshmanan

Hi lakksh,

I think you should definitely give it a try. You have the credentials to get approved. The thing which matters is how you present your case. Do due diligence and try to get documents to substantiate as much as you can... Write a nice cover letter and you should be fine. Write a letter which is clear and concise. There is no need to write a 30 page letter (although there are many folks in this forum who wrote long cover letter and also got approved). In my case my lawyer wrote a 6 page cover letter which just had a paragraph or two describing each criterion. My lawyer's view was that you don't want to irritate the examiner, so just be succinct.

One important thing is to know exactly what criteria you are claiming. Don't claim a criterion if you have a weak evidence (example could be claiming fellowship as an award). Basically, you do not want to "dilute" your case. Claim criteria where you have a solid case and casually mention all other weak accomplishments.

Thanks Gc eb1a. Yes lawyers did say that the key point is reco letters and cover letter only.

Thanks so mucg again

You should certainly give it a try, especially since you can get strong letters to support your petition. Go with the attorney who is confident and specializes in this area.
