EB cases to backlog in Jan. 2005

Dear Clients,

Beginning JANUARY, 1, 2005, employment based immigrant visa petitions
for persons in the third preference category (i.e., those whose jobs
require not higher than a bachelor's degree) will backlog for persons
charged to CHINA, INDIA AND THE PHILIPPINES.

We have tried to reach each of you personally, who may be affected by
this. However, if you have not heard from us and if you have an
approved labor certification (or are a nurse or physical therapist) who
has not yet filed an adjustment of status, please call me asap.

I don't think this will affect those who have aldready applied for I485 :) .
This retrogression only affects those who have yet to apply for I485. They cannot apply till the date becomes current.
Coorect me if I am wrong :confused: :confused:

Employment Visa Numbers Retrogress!

As predicted, the Department of State (DOS) has announced that the Employment Based, 3rd Preference (EB3) visa numbers for India, mainland China, and the Philippines will retrogress on January 1, 2005. The EB3 numbers for nationals of the listed countries will retrogress to January 1, 2002. This means that, as of January 1, 2005, anyone who is the beneficiary of a labor certification (or I-140 if a labor certification was not required) in the EB3 category filed on or after January 1, 2002, will not be permitted to file the I-485 or have a consular interview for an immigrant visa until the numbers move beyond this date. The DOS has indicated that further retrogression may be possible in future months. A question that we at The Law Office of Sheela Murthy are often asked is: What happens now that the Priority Date will regress for my application?

If a person has already filed the I-485 application when the dates were current, but then the Visa Bulletin date retrogresses to a date before the priority date, the foreign national would still accrue the benefit of being able to remain in the U.S. with renewable EAD or work authorization and permission to travel, even after completing the six years on H1B status in the U.S. However, the I-485 could not be approved until the date again becomes "current."

But what happens to cases with RFE

will they be approved even though the PD is after Jan 2002/ or will these cases have to wiat
in sum- when they do the quota- do they factor in rfe issued and ready to adjudicate cases
