Hi friends:
I just filed I-140/485 cocurrent(No labor certificate required). I noticed EB-3 will likely retrogresse to 2002 in near future. Will Immigration Service process my I-485 when I-140 is approved although visa priority date is not available?
I don't know how they will treat concurrent filing if EB-3 visa numbers are not available. Thanks a lot!

I140 and I485 will sit still until a visa number is available. AP and EAD will still be issued/extended.

Concurrent filing beginning from Jan 2005

As many of you aware that visa number is going to retrogess beginning from Jan 2005.

Do you think we are still eligible for concurrent filing even if the visa numbers not available beginning from next year?

Thanks

Good Luck

As per the above document, concurrent filing is accepted if and only if
VISA numbers are available for that period. So, does it mean that who
already applied concurrently till now ( I mean till this retrogress takes into
effect) will be processed irrespective of the PD retrogress cut-off date?

No. According to the online immigration sites, your I-485 won't be processed even your application was accepted at the time visa number was available.

Do you have an idea about PD cut-off date? like which year and month.

The definition of cutoff date: The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits.

So it'll be that person's priority date.
