I am about to apply my PERM for EB-2. I graduated in Dec 1999 and I started with my new employer in Dec 04. I am actually lacking around 10-20 days of exp for EB-2 qual due to my gap in employement dates.
My lawyer is warning me that I might not be qualified for EB-2 cos CIS will sit and count the exact # of days for EB-2 and since I am short of 10-15 days I migh get denied.
The lawyer also mentioned that if that happens then we will have to redo the whole PERM porcess as CIS does not ammend the case to EB-3 anymore.
In other words I will have to re do the recruitment efforts/ PERM for EB-3 and then 140.
GURUS - pls help - if EB-2 is risky as it sounds I dont want to spend all this # of months and money and then re do the whole process again.
