EB-1 OR (opinion wanted) URGENT

I am trying to get my I-140/I485 petition in before the boom is lowered. Tell me if this would be reasonable.

1) Faculty in top 10 department
2) 14 Journal pubs (nearly 150 citations for the pubs impact factor > 10 for all journals)
3) 4 articles by others about my pubs (Nature news and views, Neuron news and views etc)
4) 1 grant, 1 national/international postdoc fellowship from nonprofit
5) 8 letters (mix of US and international researchers, 2 members of the Nat'l Academy of Science)
6) Reviewer for 6 journals (included emails from editors addressed specifically to me asking me to review articles). Do not have time to get signed letters from editors.

Am filing for wife as well. My lawyer tells me that I need 1-2 years of all deposits for the I-134. Is this true?

No other issues, just worried, since my H-1B is about to reach the 6 year limit. Have labor filed pre PERM, so extension may not be an issue
 
if you have eb1-or papers done and ready go ahead your case looks strong..

i would have preferred NIW since your profile is very strong...that way even if you dont get 485 for a long time....you can work for different employers on ead.


if you have eb1-or ready hurry up and file.....ignore my second paragraph about NIW

I have all the letters (in record time). The other stuff is public knowledge anyway. I don't have the bank statements for the affidavit of support. Another question, what do I have to fill in the I-134 for my wife: where it asks whether the person on whose behalf the petition is being filed is wholly or partially dependent on me. My wife makes more money than I, so she will not be relying on my support.

Also, what do I write what are the specific contributions that I intend to make?

Looks fine. (I guess the large majority of your letters (5-6) are from completely independent scientists). And I guess you also have a letter confirming from your HR that you have a permanent position.
Grants and postdoc fellowhips might not fly, really depends how much supporting evidences you have added. And most likely to get an RFE regarding referee and not having signed letters from editor (own experience).

Wonderful for Eb1-OR, I am sure you have a case! just do it!
However, I will not be surprised if you get RFE on certain issues....But surely no scope of rejections. As they are responding well on time for EB1-OR cases. I would like to suggest that whatever else is required should be ready......liek letters from editors...etc. make sure you also clarify permanent job issue!
 
The letters (5 of them) are from folks that I know by reputation (and they by mine) including the NAS members. The job is a tenure-track (as permanent as they come), NOT soft money.

the grant is called an award and the fellowship is pretty darn competitive. but who knows. I was worried about the emails v/s letter from editors, but given the really short amount of time, it is a miracle that I got the other stuff done.

Make it clear with a letter from HR that your job is permanent. Always assume that USCIS has not clue and better send more evidences than expected, IMO. Fellowships for postdocs, even competitive one, are tough with USCIS, because it is "just" for a postdoc position which they believe is too early to be for an outstanding scientists (own experience with RFE).
