EB-1 OR ...3 Years Experience?

I have finished my Ph. D. in 2006 in US and doing posdoc in university. My university is ready to do EB-1 OR as a permanent research position. Will it be compulsory to have 3 years of experience after Ph. D or Ph. D experience is also considered as the experience? Does anybody have any idea about this? I appreciate ur suggestions.

The requirements are pretty clear:
(ii) Evidence that the alien has at least three years of experience in teaching and/or research in the academic field. Experience in teaching or research while working on an advanced degree will only be acceptable if the alien has acquired the degree, and if the teaching duties were such that he or she had full responsibility for the class taught or if the research conducted toward the degree has been recognized within the academic field as outstanding. Evidence of teaching and/or research experience shall be in the form of letter(s) from current or former employer(s) and shall include the name, address, and title of the writer, and a specific description of the duties performed by the alien;

As stated in the Interoffice Memorandum p. 42, the evidence you give must demonstrate that the alien is recognized internationally as outstanding in the academic field specified in the petition. (it's underlined in the document...).

Chris thank you very much for ur help and suggestion. I saw one posting few days back about the denial EB-1 OR because of the experience counted from Ph. D. in this forum. Thats y I got this question? once again thanks for ur help...

It can indeed be denied if the evidence does not demonstrate that your research work done for your PhD is indeed outstanding.

A good objective way to demonstrate this is citations of the paper(s) that came direclty from your PhD work, even better if one of the papers was published while you were still working toward your PhD.

I do have a few papers published during my Ph.D study. Citations are not strong though. Do you think that can be outstanding and counted for some experience?

Another question: can the experience before PhD study and in a different research field be counted as part of 3 year experience?

Well, do you think these few papers are astounding?

You know, if you are yourself not convinced that they are outstanding, no need to mention them as such! If you do, you will have to find convincing arguments. They better convince you first if you want to convince the adjudicator!

As for experience in a different research field, it is not likely to count as contribution in the field in which you claim to be outstanding. There is nothing like a multi-field petition that I know of. However, it you demonstrated qualities (like leadership or...), you could use it as an evidence of that quality, while recognizing yourself that it is in another field but still worth mentioning.

I wonder who gonna provide signature on I-140. Is it from Dean of Colleage or Chair of Department? Also, is it grant base? I am in similar situation. I like to know if it's okay to have Chair's signature in case that Dean's not willing to support me. Also, are you going to do DIY or lawyer will do it for you?

According to my ISO, they strongly suggest me that 3 years of post-doc experience. Just FYI.
