EB -1 Am i ready for it?

Hi

I am new to this forum. First I congratulate the help and service you offer in this forum. Thank you on behalf of all buddies.

I in US since sept 2006. I am keen to apply for GC.
Many of my colleagues and seniors say i am ready to go for EB-1.
I have listed my achievements below; please comment.

MD 1996
Fellow of Indian college of General practitioners 1997
Member of Royal college of surgeons of Edinburgh 2003
Masters in surgery (MS) 2003- Awarded Gold medal for Best outgoing of the state, Chennai, India.

Worked as Urology research fellow in North Wales, UK for 12months
Specialist registrar - urology - University of Wales, Cardiff, UK -12months
Senior Research associate in urology from Sept 2006 at good US university.

-12 peer reviewed publications (+4 submitted)
- 3 book chapters
- 28 international presentations (poster+podium)
- co investigator in 6 research projects
- 1 competed departmental grant - principal investigator
- 1 award -Gold medal for best candidate in MS
- 6 professional memberships
- reviewer for one journal

Please let me know what is the chance I can get approval in EB1.
I am planning to get assistance from a good attorney.
Whihc category would be best suited for me?

You may actually have a good chance - it's all about presentation of your credentials in a manner that shows that you have attained recognition that places you among the top in your field. If you answer YES to many of the questions below, your chances become a lot better - provided of course that you can produce the required evidence for your affirmative answer to present to USCIS:

-12 peer reviewed publications (+4 submitted)
Are any or most of these articles well-cited in other journals? Have any or most been used as a springboard for other novel research?
- 3 book chapters
Are any of them invited? If so, can you provide the invitations addressed to YOU that show that you are being asked to write a chapter based on your expertise in the field?
- 28 international presentations (poster+podium)
Are any of them invited based on your expertise and/or reputation? Were they presented to a good mix of different symposia and/or in different countries?
- co investigator in 6 research projects
Can you provide evidence that any of these projects is of great interest and high importance in your field (this is where the required support letters come in)
- 1 competed departmental grant - principal investigator
Can you get letters of support from established and reputable scientist in your field that can attest to the importance of this project?
- 1 award -Gold medal for best candidate in MS
Can you provide evidence (such as information about this award) that this is a competitive national or international award, and not just restricted to your institution?
- 6 professional memberships
Are any of them based on selection and/or election by a board of directors or by highly reputable scientist in your field? Memberships that you attain just by paying annual dues generally do not count for EB1.
- reviewer for one journal
Can you provide a letter of invitation to become a reviewer that states that you are being asked to review based on your professional expertise and/or reputation?

You are qualified for EB-1. Get yourself a competent lawyer and get it done ASAP without wasting time and energy doing a self-petition. This forum is invaluable in providing knowledge of the mechanics of the process and the personal experiences of folks who have already been through the process. I agree it is not rocket science to file a self petition, but at the same time it is not worth it trying to reinvent the wheel in my opinion.
 
Which EB1?

I wonder which EB1 you are envisioning... EB1-EA could be borderline, even if well presented by a lawyer.

And to comment on NIW2's comment, I find the self-filing not really a burden, in the sense that most of the wok to be done would have to be done anyway even if a lawyer is involved. The evidence, finding the papers you wrote or those who have been written about it, getting citation information, asking reference letters etc. takes YOUR time whatever way you choose (layer or self filing).

Selecting what to keep and what to reject does not take much time, once you have looked at the rejection files and the various comments made on this forum and on lawyers' web based information.

I think you are good for EB1A!

Your awards may not be strong enough for EB1, write to people who used awards for their approval and enquire.

Get letters which say how good you are already (do NOT talk about potential to be good, for EB1A) and write a nice cover letter; whenever you claim something, back it up by a exhibit.

As to whether it is EB-1A or not, I am sure there are number of anecdotal evidence from forum members and including my own where friends and colleagues have got the EB-1A approved with lesser qualifications than RAN973. On the same hand there have been posts my members who have RFE with pretty good achievements. So I doubt there is anything like borderline or an absolute (unless you have won the nobel prize or something like that)

This is my experience with an attorney. I had filed my case through a lawyer and prior to that I had spent 6 months reading every post available on the issue. And then decided to go with an attorney recommended to me by my Chinese colleague and got the damn thing filed within a month. With no sweat except putting together copies of my publications and presentations etc. In my case my attorney prepared all the draft letters and I had merely to review them. He was able to point out to a lot of little things that I would have missed.

I spent around 2000 initially and the lawyer required me to pay the remainder only on approval. So in my opinion it was worth it. It saved me from putting all my energy into this, second guessing myself every time and spending all the time writing those recommendation letters. The hardest part was trying to come with different letters. The attorney did the whole thing in couple of days.

For me this forum was very helpful in providing my valuable insights into the process, trying to upgrade my credentials (association memberships, journal review etc..) and it also helped me judge if the attorney was good or not. That is the reason for this long reply.

Yeah, I could have done a self petition but it would have taken me a lot of time and in end could have screwed it up also. Having said this, I am sure there are lot of folks who have done it on their own and have been successful while others have failed. But in the end I feel that hiring a professional is extremely helpful to the success of a case and stress free.

I have the publications in good journals, ad citations are few. (only 3) Thats because most of them published in last 6 months.

Most of my presentations were international, and in good gatherings. I have good evidence on that part.

I made up my mind to go for a good lawyer who will help me throughout.

The point is, I want to minimize the chance of rejection to as low as possible.
If anyone thinks i should apply in some other category other than EB-1 please advice. As i said before I am new to this forum and I will be watching closely all your opinion and make a decision.

borderline? some comments

Hi!

Sorry for the late answer.

I think there are borderline justifications for a given criterion in the EB1-EA process, though others may disagree.

Criterion (iv):
"Evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specialization for which classification is sought"
is clearly one which is open to a lot of interpration from those looking at your file. In some of the appeal documents, it is noted that it is normal for researchers to evaluate the work of their peers. In other words, it is not extraordinary to have refereed tens of papers. If the editor can write that you have been chosen as a referee due to your own leadership in your field, that can works There are times when a not so clear statement will not help... (like a mere confirmation that indeed you were the referee of many papers because you are good).

Criterion 1 (awards) bears the same kind of interpreation latitude. An award given to young people (at MS level for exemple) does not necessarily demonstrate that you have risen to the top of your field. It shows potential, but often the appeals stress that demonstration is needed, not just hope, and finely denies this kind of evidence.

I am preparing my file, and I am not sure I will claim (4) based on my own referee work (and I refereed many papers over the years). I will see the kind of letters the editors are going to write for me. I decided to forget about (2), because none of my memberships are based on extraordinary work. They are for scientists in my field, with a PhD and a few publications, and the sponsoring of a couple of members. From what I read on this forum and in the appeals, the chances that it would count are very slim.
