Early Interview Date

I received my interview letter yesterday. The interview will be on Oct 9, 2009. My 5 year anniversary on GC Date is Oct 27, 2009. Was under the assumption that the interview would always be after you "naturalized" for 5/3 years? :confused:

So, what will happen in my case. Will I have interview and then get the Oath letter in mail?

Anyone was/in similar situation?

Interesting Question. I would think that you get the first available oath held after Oct 25th to complete your 5 years regardless of if it will be mail or hand out. I would bring it to IO attention if they date your oath before your 5 years because knowing USCIS you don't want to send home when show up for oath because they did not notice it at interview.

I researched the forum and a few HAVE interview dates before they completed 5/3 years. As pointed by Immigrant66 will see that the Oath Date is later than Oct 27, 2009.
 
It is legally acceptable for the interview to be before the 5-year anniversary. However, sometimes you show up for the interview and they reschedule it, or they send a reschedule notice before the originally scheduled date. They are inconsistent on how they handle it.

One individual on this forum had their interview shortly before the 5-year mark. That location had same-day oath, and the IO actually was going to put them in the same day oath. But the person pointed it out and the oath was postponed for the 5-year anniversary itself. If it was not postponed, the individual would have been in danger of having their citizenship revoked if USCIS discovered the error in the future. Still, the probability of that occurring would be very low ... in such a situation, because there is no criminality or lying involved, the consequence of denaturalization would be to revert to permanent resident status, and then the person could just immediately reapply for citizenship so the government wouldn't really gain anything by revoking their citizenship.
 
Better to bring it up during the interview and make sure the oath is scheduled after the 5 year anniversary date. If you compromise on the issue now knowingly, you will be anxious forever.

USCIS is not in the 'denaturalization' business, I bet you they have no process or procedure for catching errors... They make a decision and run with it.

IMHO, It is in your best interest to get the IL as soon as possible and be done with the interview as soon as possible.
 
Folks,

I was reading this post and sure enough, I fall into the same category. I got my GC on 10/8/2009. Does that mean I'm only eligible for the oath by 10/8/09? My interview is o 10/5, which means I will be a few days away from my 5 years mark.

Any thoughts on what I should do?
