Ead

If the EAD renewal is approved by online message but not received the card in hand, can I legally work? If not, can I still apply for an interim EAD in the local INS office?

Thanks,

May

Unfortunately, the answer is No and No. U cannot work based on just the approval status, u would need the card. And as ur case if already adjudicated, interim EAD does not applies to u.. See: http://www.immihelp.com/gc/aos/ead.html

Is ur card lost in mail or u are just eager to start asap without waiting for mail delivery? If the case is former, u could still try talking to the local office...

atlantabhopali, please

My situation really sucks.

My EAD rd is 10/01/03, and expiration of my old card is 01/02/04. so I want to walk in the local office on 01/02/04. On that date, I will be eligible to apply for an interim EAD.

The concern is if my renewal would be approved before 01/02/04, I won't receive the card within the near future, what should I do?

My employer is ok, they don't care too much. It is my burden to make all these things ok, and also my lawyer is a really bad one. Please help me!

Maymai,

Sorry to hear abt ur situation. The law is that u can not work on EAD without actually getting the card. If u do, ur employer may be fined for employing unauthorized immigration workers.

U can try to atleast visit local office and see what they can do.. Alternatively, ask ur employer to hold the checks of ur salary till u receive the card. Once u receive the card, he can pay u everything as bonus etc and BCIS would not really know that u worked without EAD.. cheesy but works!

goodluck

Generally EAD is effective from approval date. So if your EAD is approved I dont see any harm in continuing employment.
On the remote possibility of EAD card getting lost in post, you can apply for an EAD to replace the lost EAD.
You can also go to the local INS office and get an interim EAD if it is past 90 days and approval has not been accorded.
