EAD with current H1B

I am in the process of renewing my actual H1B but due to internal employer problems, this is taking more than expected.

I applied for NIW back in Oct 2006 but this is still pending.

The question is whether I should apply for EAD and how long does it takes to get it?

Only if you from non-retrogressed country you can apply for I-765 (EAD) based on concurrently applying for I-485. If you did apply for I-485 during the July fiasco, then you can apply for EAD based on that pending one. But you cannot apply for EAD just based on your pending NIW.
