EAD with 485 pending will become 2 years instead of one!!!

Ok I can't read chinese. So they are saying that they will give EAD's that will be valid for 2 years instead of 1? That makes sense.

Also that means they have no plans of speeding up 485.

2 year validity ONLY for EAD with 485 pending. They will announce it in December 2003.

Remember last year (7/30/2002) BCIS announced 140/485 concurrent filing and it took effect on 8/1/2002.

I think this may take effect either 12/2003 or 1/2004.
 
Very bad news if this is true. They are doing whatever they can to slow down the 485 process. Sucks
 
How will this slow down the 485 process? This looks like an attempt reducing the volume of applications so that resources can be directed to more important things.

I'm disappointed that my GC is taking so long just like everyone else but I'm don't think this is a sign that the process is going to get any slower. If anything this makes a lot of sense and seems like an acknowledgement that there are problems in the current process that the BCIS is trying to correct. For instance, if they know the waiting time for a GC is going to be more than 12 months why issue work permits that are only good for a year? It only increases the number of applications that need to be adjudicated when people re-apply. So many people have complained about expiring EADs and the cost of re-applying that I assumed this would be welcome news.
 
EAD valid for 2 years is a good news.



Comparing to 5 to 10 years of waiting period for family GC,
2 year is far better for the employment GC.

They have to process the employment GC within this 2 years, otherwise it will be same as what we face now.
 
If you guys recalled some info from the AAIL meeting with INS staff, they said that since EB based applicants are supposed to work for the sponsoring company so they do not worry the long wait of Eb based applicants.

In the sense that resources are released to work on other application, it is indeed a good sign. But how you know that released officers will be working on 485.

EAD valid for two year, they will not issue FP notice until after 9 months, all are pointing to the same factthat they do not intend to approve any 485 case in two years after filing or even more time.

This is absolutely a deteriation not in any way an improvement.
 
Take it easy. "2 year EAD" is not final decision. INS wanted to do this one or two year ago, but EAD's still good for one year.
 
EB based applicants are supposed to work for the sponsoring company. So there is no need for them to approve the I485 within a short period. If you are laid off by the sponsored company or the sponsored company is closed, we have the option to use the AC21 rule.(after 6 months)
