EAD: What happens if H1B is still valid

This issue has been discussed many times on various sites. The advantage of H1B is that you can marry and bring your spouse on H4 any time prior to 485 approval relatively easily. Another advantage is that you don\'t have to leave the country in case of a 485 denial since you can continue working on H1. The disadvantage of being on H1 and advantage on being on EAD is that you can save your H1 time. Secondly, some interpretation of the new AC-21 law says that you should be working on EAD to change jobs after 180 days. Hope this helps. More info can be found on sites like immihelp.com.

You mentioned that the advantage of being on EAD as opposed to H1 is that you can save H1 time. I am on H1 now but am facing possible layoff. My husband is the primary applicant of GC. If I apply for an EAD and use it to look for another job after being laid off, but our 485 gets denied later, will I be able to go back to my H1?
