My H-1 is going to expire in Sep-2002. My company is giving me an option of EAD or H-1. I need some advice about the option to take. Here are details of I-485 application
RD Dec 14, 2001
ND Dec 26, 2001
Spouse EAD Jan 18, 2002
Spouse AP Jan 28, 2002
I think EAD will be a better choice which will give a chance to change your employer easily in case you want to change before your final approval.Again lets wait what other guys say...good luck!!!
1) You can switch job easily after 6 Month with EAD;
2) Save a lot of money and time for you and your company;
3) Save your H-1 time if you want to back to H-1 again.(I don\'t think this will happen to you).
1. if you are unmarried you can bring your spouse on H4 when you do get married.
2. you have no problem of legality/ out of status issue in case you are sponsering your parents/relative to visit you.
3. GOD Forbid, if your 485 is denied due to any reason you are not out of staus.
4. Easier to travel abroad on H1.
5. Employer has to keep on paying you the promised salary on H1.
with EAD :
1. you have to get AP and keep renewing it if you want to go out of country.
2. If your 485 is denied you are out of status.
3. spouse can not join you on H4.
4. Company can reduce your salary or stop paying you altogether.
