EAD v/s H1

I-140 and 485 files in 2003 Sept.

I have 5 months remaining on my H1 visa.
I also have a EAD card which is valid for the next 10 months.


The company is in the process of a merger and might eliminate some jobs.

What are my options now.

1. Are there any benefits of staying on H1 (other than the usual) given this particular situation

Assuming I dont have an approved 140 in the next 5 months, and I get laid off.... Is it better to be on H1 or EAD

If you do not get your I-140 approved in next 5 months and ur company lay you off and then you try to use EAD to get another job,in other words, changing employer before I-140 is approved and in that case if your company revoke your i-140, u may be in trouble, if INS decide to cancel ur i-485 as ur I-140 application is revoked,your EAD would not be valid and u would have lost ur h1b status by now as u have used EAD, this may cause some problme for you,My personal openion is that it would be better to be on H1b, any correction,addition friends ?
